ErrandWorks Terms and Conditions Policy

By accessing or using the ErrandWorks website (https://errandworks.me), mobile application, or marketplace platform (collectively, the “Platform”), you (“User,” “Customer,” “Client,” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Platform.
ErrandWorks (“ErrandWorks,” “Company,” “we,” “us,” or “our”) operates a service marketplace that connects Customers with vetted, background-checked independent service providers (“Providers”) in the Eatonton, Georgia area and surrounding communities. Providers are independent contractors and are not employees, agents, joint venturers, or partners of ErrandWorks.
1. Scope of Services
1.1 Marketplace Role. ErrandWorks provides an online venue for Customers to discover, request, schedule, and pay for services offered by independent Providers. We facilitate communications, scheduling, and payments but do not perform or supervise the services.
1.2 Types of Services. The Platform lists a broad range of services, which may include grocery shopping and delivery, house cleaning, senior assistance, event planning, junk removal and organizing, pet care, office administrative tasks, home repairs and maintenance, prescription pickup, landscaping and yard maintenance, general errands (e.g., post office runs and dry cleaning pickup), and other specialized services as available from time to time. Listings are descriptive only and may change.
1.3 Geographic Limitation. Services are currently available in Eatonton, GA and nearby communities as determined by ErrandWorks. Availability may vary based on Provider capacity, location, and other factors.
1.4 No Endorsement or Warranty. We vet Providers, but we do not control or guarantee the quality, safety, legality, timing, or outcome of any service. Any statements about a Provider (e.g., ratings, reviews, credentials) are provided for convenience and are not endorsements.
1.5 No Employment Relationship. ErrandWorks is not an employer of Providers, does not direct the manner or means of their work, and does not provide workers’ compensation for Providers. Providers set their own schedules, tools, methods, and professional standards subject to applicable law and these Terms.
1.6 Availability; Changes. We may improve, modify, suspend, or discontinue features or services at any time. Certain services may be subject to additional terms presented at booking; if there is a conflict, the service-specific terms govern for that service.
2. Eligibility and Registration Rules
2.1 Eligibility. You must be at least 18 years old and have legal capacity to enter binding contracts. If you register on behalf of a business, you represent that you have authority to bind that business.
2.2 Account Registration. You agree to provide accurate, current, and complete information, maintain it, and safeguard your login credentials. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
2.3 Identity Verification; Screenings. We may require identity and eligibility verification and may use third parties for this purpose. Providers may be subject to background checks, licensing verification, and other screening, subject to applicable law. We make no guarantee as to the completeness of any screening.
2.4 One Account; Non-Transferability. You may maintain only one Customer account and one Provider account per person, and you may not transfer your account.
2.5 Communications Consent. You consent to receive communications (including emails, calls, and text messages) related to your account and services. Message and data rates may apply. You may opt out of non-essential communications as permitted by law.
2.6 E-Sign Consent. You agree to transact electronically and accept electronic records and signatures in connection with the Platform.
2.7 Compliance. You agree to comply with these Terms, service-specific terms, and all applicable federal, state, and local laws and regulations.
3. Payments, Deposits, and Service Fees
3.1 Prices and Estimates. Provider rates and/or fixed prices are shown prior to booking or quoted through the Platform. Estimates are not guarantees. Final charges may vary based on actual time, scope, materials, or circumstances.
3.2 Payment Processing. Payments are processed by ErrandWorks or our third-party payment processors on behalf of Providers. By booking, you authorize ErrandWorks to (a) place a pre-authorization or deposit hold on your payment method, (b) charge your payment method for service fees, Platform fees, taxes, tips, and other amounts disclosed at booking or incurred under these Terms, and (c) issue adjustments or refunds as applicable.
3.3 Platform and Processing Fees. We may charge Platform/service fees, booking fees, and payment processing fees, which will be disclosed at checkout. Such fees are generally non-refundable except where prohibited by law.
3.4 Taxes; Gratuities. Providers are responsible for their own tax obligations. Where required, applicable taxes will be collected. Gratuities are optional unless stated and, if paid through the Platform, are non-refundable once the service is completed.
3.5 No Cash or Off-Platform Payments. Cash payments, checks, or off-Platform payments are prohibited. Any attempt to circumvent the Platform may result in account suspension or termination and may incur a fee equal to the avoided Platform fees and costs of collection.
3.6 Adjustments; Additional Time/Materials. If the service requires additional time or materials beyond the original scope, you authorize corresponding additional charges.
3.7 Chargebacks and Collections. If you initiate a chargeback without valid basis, we may suspend or terminate your account, and you will be responsible for all resulting fees, costs, and reasonable attorneys’ fees. We may use collection agencies and may offset amounts you owe against amounts payable to you.
3.8 Late Payments. Unpaid amounts may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.
4. Cancellation and Refund Policy
4.1 Customer Cancellations. Service-specific cancellation terms are shown at booking and govern. If no service-specific terms are presented, the default policy applies:
- Cancellations made more than 24 hours before the scheduled start: refund of service fees, less non-refundable Platform/processing fees.
- Cancellations made within 24 hours but at least 2 hours before start: a reasonable cancellation fee up to 50% of the estimated service amount (or the minimum service charge), plus non-refundable Platform/processing fees.
- Cancellations made less than 2 hours before start or where the Provider cannot access the premises or Customer is a no-show: up to 100% of the minimum service charge or first hour (as applicable), plus non-refundable Platform/processing fees.
4.2 Provider Cancellations. If a Provider cancels due to illness, safety concerns, weather, or other reasonable circumstances, we will work to reschedule or provide a refund of amounts paid for the cancelled portion of the service.
4.3 Refunds. Approved refunds will be returned to the original payment method. Processing times vary by payment provider. Tips are non-refundable once the service has been performed.
4.4 Force Majeure. Neither ErrandWorks nor Providers are liable for delay or failure to perform due to events beyond reasonable control (e.g., severe weather, utility outages, acts of God).
4.5 Service Issues. Report service quality, damage, or billing issues through the Platform within 72 hours of service completion so we can assist with resolution under Section 8.
5. Service Provider and Customer Responsibilities
5.1 Provider Responsibilities. Providers must:
- Maintain required licenses, permits, and insurance for services they perform;
- Provide services with reasonable skill, care, and professionalism;
- Bring necessary tools and materials unless otherwise agreed;
- Comply with all applicable laws, regulations, and safety standards;
- Decline work that is unsafe, unlawful, or outside their competence; and
- Promptly report incidents, injuries, property damage, or hazards encountered.
5.2 Customer Responsibilities. Customers must: - Provide accurate service details, access instructions, and contact information;
- Ensure safe and lawful working conditions, including securing pets and disclosing hazards;
- Have the legal right and necessary permissions to request services at the location;
- Obtain required permits or approvals;
- Provide access to utilities (e.g., water, electricity) where relevant; and
- Inspect the work at completion and promptly raise issues through the Platform.
5.3 Safety; Supervision. Providers may refuse tasks that are unsafe or unlawful. Customers must ensure responsible adult presence where required and may not leave minors unattended with Providers.
5.4 Property and Valuables. Please secure valuables and fragile items before service. ErrandWorks is not responsible for loss of or damage to items of extraordinary value unless expressly agreed in writing.
6. Prohibited Uses and Activities
You agree not to:
- Request, offer, or perform any illegal, unsafe, or prohibited service;
- Violate any law, regulation, or court order;
- Harass, threaten, or discriminate against any User or Provider;
- Circumvent the Platform to avoid fees or process off-Platform payments;
- Misrepresent identity, qualifications, or affiliations;
- Interfere with Platform operation, scrape or harvest data, or introduce malware;
- Post or transmit content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable;
- Request services involving hazardous materials, weapons, controlled substances, or activities requiring specialized licensing unless properly licensed and permitted; or
- Use the Platform for unsolicited marketing or spam.
7. Limitation of Liability and Waivers
7.1 Assumption of Risk; Release. You understand that interactions with Providers involve inherent risks. To the fullest extent permitted by law, you voluntarily assume such risks and release ErrandWorks and its affiliates, officers, directors, employees, insurers, and agents (“ErrandWorks Parties”) from claims, demands, and damages arising from or related to interactions with Providers or other Users, except to the extent caused by ErrandWorks’ willful misconduct.
7.2 No Warranties. The Platform is provided “as is” and “as available.” ErrandWorks disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant any Provider’s work, timelines, or outcomes.
7.3 Limitation of Liability. To the maximum extent permitted by law, ErrandWorks Parties’ total liability for claims arising out of or relating to the Platform or services shall not exceed the amount you paid for the service giving rise to the claim.
7.4 Excluded Damages. ErrandWorks Parties are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, data, or goodwill, even if advised of the possibility.
7.5 Basis of the Bargain. The limitations above are fundamental elements of the agreement between you and ErrandWorks.
8. Dispute Resolution Procedures
8.1 Informal Resolution. Before initiating formal action, you agree to email support@errandworks.me with a description of the dispute and your requested resolution. We will attempt to resolve the dispute in good faith within 30 days.
8.2 Binding Arbitration; Small Claims Carve-Out. Except for individual claims filed in small claims court (if available) or claims seeking injunctive relief for unauthorized use or abuse of the Platform, all disputes between you and ErrandWorks arising out of or relating to these Terms or the Platform will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration may be conducted by video/telephone, on written submissions, or in Putnam County, Georgia, unless otherwise agreed.
8.3 Class Action and Jury Trial Waiver. YOU AND ERRANDWORKS AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS OR REPRESENTATIVE PROCEEDING. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
8.4 Opt-Out. You may opt out of the arbitration agreement by sending a written notice to support@errandworks.me or to the mailing address in Section 10 within 30 days of your first acceptance of these Terms.
8.5 Fees and Awards. The arbitrator may award individual relief permitted by law. Payment of AAA fees will be governed by AAA rules. The prevailing party may be awarded costs and fees to the extent permitted by law.
8.6 Time to Bring Claims. Any claim must be filed within one (1) year after it arose or be forever barred, unless a longer period is required by law.
9. Privacy and Data Handling
9.1 Privacy Policy. Our collection, use, and sharing of personal information are described in our Privacy Policy (incorporated by reference). For certain caregiving or assistance services, we are not a healthcare provider or a covered entity under HIPAA; however, our HIPAA Policy (where applicable) and Data Security Policy describe how we safeguard sensitive information.
9.2 Data Sharing. To facilitate services, we may share necessary information with Providers and third-party processors (e.g., for payments, communications, identity verification, mapping, and background checks).
9.3 Communications and Recording. We may monitor or record communications for quality and training where permitted by law. By using the Platform, you consent to such practices.
9.4 Location and Device Data. Certain features may require access to location or device information. You can manage permissions in your device settings, but some features may not function without them.
9.5 Security. We implement reasonable safeguards but cannot guarantee absolute security. You are responsible for maintaining the security of your account.

11. Licensed and Regulated Services
11.1 Licensing. Certain services (e.g., specialized trades, regulated caregiving, or transportation of regulated goods) may require specific licenses, permits, or certifications. Providers are solely responsible for holding and maintaining all required licensing and insurance.
11.2 Verification. ErrandWorks may request proof of licensing or insurance but does not guarantee the validity, sufficiency, or currency of any such documents.
11.3 Health-Related Services. ErrandWorks does not provide medical, nursing, or other professional healthcare services. Any health-related services must be performed only by appropriately licensed Providers, and no information on the Platform constitutes medical advice.
11.4 Compliance. Customers are responsible for ensuring that requested services are lawful and permitted at the service location.
12. Changes to Services or Terms
12.1 Updates to the Platform. We may update or discontinue features or services at any time without notice, subject to applicable law.
12.2 Updates to Terms. We may modify these Terms from time to time. Material changes will be communicated via the Platform or email. Changes are effective upon posting unless otherwise stated. Your continued use after changes become effective constitutes acceptance.
12.3 Changes to Fees. We may modify fees with prospective effect; any such changes will be disclosed prior to booking.
13. Intellectual Property Rights
13.1 Ownership. ErrandWorks owns the Platform and all related content, trademarks, logos, and intellectual property rights, except for User-generated content.
13.2 Limited License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes.
13.3 User Content; Reviews. By submitting content (including reviews, feedback, photos, or communications), you grant ErrandWorks a worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and perform such content in connection with operating and promoting the Platform. You represent that you have necessary rights to grant this license and that your content does not infringe any third-party rights.
13.4 Feedback. If you provide feedback or suggestions, we may use them without restriction or compensation.
13.5 Infringement. If you believe content infringes your rights, contact us at support@errandworks.me with details.
14. Third-Party Services
The Platform may reference or integrate third-party services (e.g., payment processors, mapping, communications, identity verification). Those services are governed by their own terms and privacy policies. ErrandWorks is not responsible for third-party acts or omissions, websites, or services.
15. Termination of Accounts
15.1 By You. You may terminate your account at any time by contacting support. Outstanding obligations (including unpaid fees) survive termination.
15.2 By ErrandWorks. We may suspend or terminate access immediately for actual or suspected violations of these Terms, fraud, abuse, non-payment, safety concerns, or as required by law.
15.3 Effect of Termination. Upon termination, your right to use the Platform ceases immediately. We may retain information as required or permitted by law and our policies. We may also cancel pending bookings in our discretion.
16. Indemnification
You agree to defend, indemnify, and hold harmless ErrandWorks Parties from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform or services; (b) your content or feedback; (c) your breach of these Terms or violation of law; (d) your interactions with Providers or other Users; or (e) property damage or personal injury caused by you. We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
17. Jurisdiction and Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Subject to Section 8 (Arbitration), the exclusive venue for any non-arbitrable claim shall be the state courts located in Putnam County, Georgia or the federal court for the Middle District of Georgia, and you consent to personal jurisdiction in those courts.
18. Miscellaneous
18.1 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
18.2 Entire Agreement. These Terms, together with policies incorporated by reference (including our Privacy Policy and any service-specific terms), constitute the entire agreement between you and ErrandWorks regarding the Platform and services and supersede prior agreements on the same subject.
18.3 No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
18.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
18.5 Headings. Headings are for convenience only and do not affect interpretation.
18.6 Survival. Sections that by their nature should survive termination will survive, including but not limited to Sections 3, 4, 6–9, 13, 16–18.
